What am I entitled to after being involved in a motorcycle accident?

After being involved in a motor vehicle accident, there are many things of which you are entitled if you are not at fault. You are entitled to money for your pain and suffering. You are entitled to money for your medical expenses. You are entitled to money for your lost wages. You are entitled to money to get your bike or car fixed and get you back on the road. You are also entitled to compensation for any permanent impairment.

The perfect scenario if you've been in an accident, is to get hit by someone that has a lot of insurance. Typically, that is not the case in Arizona. My guess is that one out of four drivers in Arizona do not have any insurance and one out of two drivers are underinsured. You should carry limits of at least 100/300 for uninsured and underinsured with your own insurance carrier. Deman it! Do not let your agent talk you out of it.

What type of motorcycle coverage should I have and how much?

Your coverage should be at least $100,000/$300,000 for underinsured and uninsured coverage besides liability so that you're covered if somebody hits you and they don't have enough insurance. If a car or a pick-up truck or worse hits you, your medical expenses will be high, you are going to be hurt, be out of work and will you need to be compensated. You are entitled to get compensated.

After the accident happens, what do I do?

After your accident, it’s best not to make any statements to anybody, especially the other person's insurance company. Their insurance company, through an adjuster, will be calling you to make a statement. Many of my clients have made statements to the other person’s insurance company and have not meant what they said. Many times the statement gets taken out of context and the liability becomes questionable. Don't talk until you talk to me!

If it's a motorcycle acccident, the typical insurance company position is because you are a motorcyclist, you were probably driving too fast or you were weaving in and out of traffic. It always becomes the fault of the motorcyclist. You are a target even though it's clearly not your fault. The insurance company may say it's "partially"; your fault just because you were on a bike.

How does Franklin & Associates charge for representing my case?

Franklin & Associates charges on a contingent basis for all accident cases. Meaning that if we collect a dollar for you, we take 33 cents. In other words, we take: 1/3 contingent fee. If I collect nothing, I take nothing. You put no money up front and we take nothing of the recovery money to get your bike fixed. If you are awarded $100 for your bike, you get that $100. We do this free of charge for you.
